Details
I am regularly instructed in respect of a wide variety of child and family law matters and conduct cases in both the Sheriff Court and the Court of Session. My main areas of practice in this field are in relation to:
- Actions in relation to parental rights and responsibilities under section 11 of the Children (Scotland) Act 1995
- Financial provision upon divorce or dissolution of a civil partnership
- Actions under section 28 of the Family Law (Scotland) Act 2006
I regularly deal with cases in this field where there are allegations of serious domestic abuse, both for the person alleging abuse and the alleged abuser and, in that context, I have experience in relation to non-molestation interdicts, non-harassment orders and exclusion orders.
I am also regularly instructed in child contact and residence actions where one or more of the children are experiencing serious and/or complex health needs, including severe physical health conditions as well as complex needs arising out of learning difficulties.
I also accept instructions in relation to referral proofs and in relation to petitions for enforcement under the Family Law Act 1986.
