I have experience of the four main pieces of FOI legislation: the Freedom of Information Act 2000, the Freedom of Information (Scotland) Act 2002, the Environmental Information (Scotland) Regulations 2004 and the Environmental Information Regulations 2004. I am also familiar with the lesser known INSPIRE Regulations 2009 and INSPIRE (Scotland) Regulations 2009.

I have advised requesters and public authorities in relation to FOI matters and have experience in relation to appeals to the First-Tier and Upper Tribunals in respect of appeals under the Freedom of Information Act 2000 as well as appeals to the Court of Session under the Freedom of Information (Scotland) Act 2002. As a solicitor, I was the principal solicitor acting for the successful appellant in Dr Ian Graham v Scottish Information Commissioner.

I gave evidence to the Public Audit and Post-Legislative Scrutiny Committee of the Scottish Parliament as part of its post-legislative scrutiny of the Freedom of Information (Scotland) Act 2002, appearing before the Committee in October 2019. I have advised foreign jurisdictions in relation to the implementation of their freedom of information laws.

As Scottish counsel, in relation to FOI matters, I can appear before the First-Tier Tribunal, Upper Tribunal, Court of Session and the Supreme Court of the United Kingdom.
