Data Protection & Privacy

Details

I have experience advising on data protection and privacy issues, both as a solicitor and since becoming an advocate. I have been instructed on behalf of controllers (both in the public and private sectors) and data subjects.

I have acted in a number of applications by data subjects for orders under the Data Protection Act 2018 seeking to enforce their rights as well as in relation to claims for compensation under the UK GDPR and the Data Protection Act 2018.

I have advised data controllers in both the public and private sectors in relation to a wide range of data protection and privacy issues, including in relation to data subjects exercising their rights under data protection law as well as compliance and enforcement issues and actions for damages.

I also have experience advising on issues pertaining to the rules on marketing in the Privacy and Electronic Communications (EC Directive) Regulations 2003.

As Scottish counsel, in relation to data protection matters, I can appear before the First-Tier Tribunal, Upper Tribunal, Sheriff Court, Court of Session and the Supreme Court of the United Kingdom. I can also be instructed to defend in prosecutions for alleged criminal conduct under the Data Protection Act 2018 which are being prosecuted in the Scottish courts.
